Assoc. Prof. Dr. Bui Anh Tuan – President of FTU gave a speech at the workshop
The 2016 UNCITRAL Viet Nam Workshop “Harmonization of Trade Law and Outlook for Practitioners in ASEAN” was held on 24 November 2016 at the Foreign Trade University, Ha Noi, Viet Nam.
Hosted jointly with the Foreign Trade University, Ha Noi, the Vietnam International Arbitration Centre, and the Vietnam Business Lawyers Club, the Workshop was devoted to the United Nations Convention on Contracts for the International Sale of Goods 1980 (CISG), following Viet Nam’s recent accession to the Convention, which will enter into force for Vietnam on 1 January 2017. The Workshop focus on various aspects of the application and implementation of the CISG, including in the contexts of electronic communications in international contracting, international commercial arbitration, government purchases, as well as the duty of uniform interpretation and contract law harmonization within ASEAN.
Professor João Ribeiro, the Head of UNCITRAL-RCAP opened the session highlighting the benefits of Vietnam’s accession to the CISG including predictability; expansion of trade; reduction of transactional costs; trust building; leveled bargaining; efficient dispute mechanism and more. The workshop raised crucial issues regarding the need for further education and increased awareness for both legal professionals and businesses to understand how the CISG may affect their interests, as well as the role of judges in applying the new law and to uphold the duty of uniform interpretation.
